أرجأت غرفة الجنايات الاستئنافية بمحكمة الاستئناف في فاس، صباح اليوم الاثنين، النظر في قضية عبد العالي حامي الدين، القيادي في حزب العدالة والتنمية، والمتهم في قضية مقتل الطالب اليساري بنعيسى آيت الجيد.
وجاء قرار المحكمة استجابةً لطلب فريق الدفاع عن حامي الدين، الذي طالب بمهلة إضافية لاستكمال التحضير للدفاع، مما دفع القاضي عز العرب أمزيان إلى تحديد موعد الجلسة المقبلة في 27 يناير.
وكانت المحكمة الابتدائية قد أدانت حامي الدين سابقا بتهمة “المشاركة في الضرب والجرح المفضي إلى الموت دون نية إحداثه”، بموجب الفصلين 129 و403 من القانون الجنائي، وقضت بسجنه ثلاث سنوات نافذة.
كما ألزمت المحكمة المتهم بدفع تعويض مدني قدره 20 ألف درهم لكل من إبراهيم آيت الجيد والحسن آيت الجيد، إضافة إلى درهم رمزي لصالح الجمعية المغربية لحقوق الإنسان.
وتتسم القضية بحساسية قانونية وسياسية كبيرة، حيث تتواصل الجهود لتحقيق العدالة للضحية وسط جدل واسع وتأجيلات متكررة.
